Kevin Jerome Gilyard was born to a Puerto Rican mother and an African American father on February 5, 1986. Before settling in Baton Rouge, he and his family moved to New Orleans, Louisiana. As a teenager
When Kevin Gates was 13, he was arrested for being a passenger in a stolen automobile. Gates was temporarily imprisoned for the infraction and stated that it had a significant impact on his life: “If they would’ve just pulled up to the jail, left me in the police car, never took me inside and just took me back home, I don’t think I’d ever have done anything else again. But what it did was—by me going into jail at such a young age—all it did was criminalize me in a sense. It kinda steered me in the wrong direction after getting there and settling in; it took the fear of jail away from me.”

Charged battery for kicking a fan
In the summer of 2015, while playing on stage in Lakeland, Florida, Gates was charged with violence after kicking a fan. In his defence, he invoked Florida’s stand-your-ground statute. Kevin Gates was found guilty of the offence and sentenced to 180 days in prison on October 26, 2016. Gates was sentenced to 30 months in jail on firearms charges coming from a 2013 incident in East Moline, Illinois 2017, but was freed on parole on January 10, 2018.

Kevin Gates filed a lawsuit in April 2018 (Kevin Gilyard v. John R. Baldwin, Ned Shwartz, and Jason Garnett) against his parole officer, the Illinois Department of Corrections (DOC), and its chief of parole for denying his requests to perform and visit family outside of Cook County, Illinois, where he was serving his probation. He claimed to have missed a number of concerts in the interim. The case was tried in the United States District Court for the Northern District of Illinois, where it was dismissed in a minute order following a summary hearing on May 2, 2018.
Gates filed an emergency petition for injunctive relief with the US Court of Appeals for the 7th Circuit, which began hearing the case on May 7, 2018.
Gates’ plea for voluntary dismissal of his own case (FRAP 42(b)) was granted on June 18 since the matter had become moot—his parole having been terminated early by the Illinois DOC in motu proprio. As a result, Gates was no longer subject to the jurisdiction of his parole officer or the MSR agreement in question. The lower court dismissed the complaint after Gates’ counsel, Ilia Usharovich, acknowledged that the matter was irrelevant because Gates’ parole had expired early.
Gates was allowed to return to live performances at The Novos in Los Angeles the following June, despite missing the JMBLYA music festival in Austin, Texas, for which he initially submitted his petitions.
Gates’ parole was set to end in January 2019.
